Ex-Tesla employee receives $137 million for structural racism | Car

A San Francisco jury has ordered Tesla to pay $136.9 million in compensation to Owen Diaz, a black ex-employee. He accused the car manufacturer of having been a victim of structural racism for years.

After four hours of deliberation, the jury agreed with Diaz that Tesla did not create a safe working environment for its black employees. He worked as an elevator operator at Tesla’s Fremont plant in northern California in 2015 and 2016. Diaz says he got racist slogans thrown at his head every day ‘including the n-word’. Factory employees also distributed swastikas and racist graffiti and drawings. Executives failed to stop the harassment.

Diaz tells The New York Times,,It took four long years to get here. It feels like a huge weight has been lifted off my shoulders.” His lawyer is also satisfied: “It’s a wonderful thing when one of the richest companies in America is judged for the terrible way they treat their black workers in the factories.”

The company must pay Diaz a civil fine of USD 130 million, in addition to emotional damages of USD 6.9 million. These payments are determined from the financial situation of the accused. It is therefore not very unusual for a billion-dollar company to pay such an amount.

Too heavy

According to Tesla, the punishment is too severe. For example, Diaz would never have been employed directly by Tesla, he would have only been employed for 9 months, and the n-word would have been said “in a friendly way,” writes the head of human resources on the site.

However, they do recognize that mistakes have been made. “While we strongly believe that these facts do not justify the verdict of the San Francisco jury, we recognize that we were not perfect in 2015 and 2016. We’re still not.’ The company promises to work hard to improve the working atmosphere in the factories.
