Lawyer Bénédicte Ficq wants to tackle Schiphol in addition to Tata Steel and the tobacco industry | Inland

Lawyer Bénédicte Ficq does not rule out a lawsuit against Schiphol. She would also like to “deal with the airport,” she said in an interview with business platform Change Inc. Ficq previously filed a lawsuit against the tobacco industry, and this year filed a complaint against steel manufacturer Tata Steel on behalf of about 1,100 people.




When asked whether Ficq himself wants to tackle other companies in addition to Tata through criminal law, the lawyer answered: ,,I would also like to tackle Schiphol. If you see what that does to the environment.”

It is necessary, Ficq explained, that local residents can demonstrate that the complaints get worse the closer you live to Schiphol: “As the RIVM report showed that the complaints of the local residents increased the closer they live to Tata.” Then ‘can I do something with it’.

According to Ficq, the government is ‘leaving citizens out in the cold, while it is established that the health of local residents is affected every day by pollution’. She was still adamant: ,,If Schiphol causes damage, it can be a matter. But if it also turns out that Schiphol adheres to all the rules, I may be left empty-handed.”

Tobacco Industry and Tata Steel

Ficq’s declaration against the tobacco industry in 2016 did not yield the desired result: the Court of Appeal in The Hague decided in 2018 that there would be no criminal case against the tobacco industry.

At the beginning of this year, the lawyer announced that she was going to file a complaint against steel manufacturer Tata Steel because the company would deliberately introduce “substances into the soil, air or surface water” that are a danger to public health. A criminal offense carrying 12 years in prison. “In contrast to the case against the tobacco industry, it is much easier to prove here that Tata Steel simply releases harmful substances into the environment in violation of the licensing rules,” she said a few months ago.
