The lawsuit against Jussie Smollett, much delayed by the corona virus, has started in Chicago. The Empire actor is accused of six cases of disturbing public order over his false declaration of a racist attack in early 2019. His lawyers claim that Smollett is the victim in this case. That reports the Chicago Tribune.
“Our client is a real victim of a real crime. The two brothers who robbed Smollett did so because they didn’t like him. The check he wrote to them for over $3,000 was for training so my client could prepare for an upcoming video clip. It was absolutely not an amount to fund a staged robbery, as the prosecutors allege,” said Nenye Uche, Smollett’s attorney. According to Uche, a third person was also present who allegedly attacked Smollett.
The actor came to the court accompanied by his mother and other relatives. Twelve jurors and three reserves have been sworn in by the court to ultimately determine Smollett’s fate. Judge James Linn expects the case to take a week to complete.
Cameras were not allowed in the room and there was no live stream to follow the whole virtually. It is not yet known whether Smollett will testify himself, although it is certain that the two brothers who allegedly assaulted him will both testify. Jurors will also be shown video footage from at least 12 security cameras located near the site where Smollett claims to have been harassed.
Smollett was initially charged with making a false report and providing false information, but not long after, all charges were dropped. The City of Chicago then launched an investigation into original prosecutor Kim Foxx and appointed a special new prosecutor to review the case. It concluded that mistakes had been made and that the actor should be charged with disturbing public order.
If found guilty, Smollett could face a prison term of one to three years. However, American media say that he will probably receive a suspended sentence at most because he has no criminal record.
